DEKONSTRUKSI PENANGANAN PELANGGARAN ADMINISTRASI YANG TERSTRUKTUR, SISTEMATIS DAN MASIF DALAM PILKADA
Abstract
Abstract
Deconstruction is a thought based on the method of reading texts that are based on philosophical values, since the 2015-2020 regional elections there have been several problems in handling structured, systematic, and massive administrative offences by Bawaslu. This research is a normative juridical research by analysing the laws and regulations related to the simultaneous local elections. This study concludes that the presence of a structured, systematic, and massive concept in the simultaneous Pilkada is based on the concept that was born in the examination of the dispute over the election results by the Constitutional Court which was then normalized into the Pilkada Law. The handling of administrative violations that are structured, systematic, and massive is categorized as difficult to prove because it uses a cumulative element. Deconstruction is carried out by changing the element of evidence in handling TSM administrative violations with an alternative – cumulative element, with the provision that alternative evidence is carried out against acts of promising or giving money or other materials proven massively. This study also suggests making changes in the construction of norms governing structured, systematic, and massive administrative violations in the Pilkada Law by using alternative – cumulative elements to achieve justice.
