<p>Selamat datang di situs resmi Jurnal Pro Natura, yang memiliki tujuan untuk memberikan sumbangsih pada eksplorasi teori dan praktik di bidang Hukum Lingkungan. Dengan semangat untuk memperkaya dan menyebarkan pengetahuan mengenai Hukum Lingkungan di Indonesia kepada masyarakat luas, situs ini menyediakan artikel jurnal untuk diunduh secara gratis.</p> <p>Pro Natura adalah jurnal akademik <em>double-blind review</em> untuk studi Hukum Lingkungan yang diterbitkan oleh Departemen Hukum Lingkungan, Fakultas Hukum, Universitas Gadjah Mada. Pro Natura menerima naskah yang berkualitas, original, dan ditulis sesuai ketentuan pada fokus topik mengenai Hukum Lingkungan dan Tata Kelola Lingkungan. Jurnal ini diterbitkan secara berkala, dua kali dalam setahun (Juni dan Desember). <p>Dengan semangat untuk memperbaiki keadaan, kami dari Departemen Hukum Lingkungan, Fakultas Hukum, Universitas Gadjah Mada, menginisiasi Jurnal Pro Natura. Jurnal ini <br>kami harapkan menjadi upaya bersama untuk mengembalikan marwah karya ilmiah sebagai medium pendidikan publik. Kami berprinsip bahwa alih-alih mem-bisnis-kan jurnal ilmiah dengan meminta penulis untuk membayar, Jurnal Pro Natura justru memberikan insentif bagi penulis yang karyanya dipublikasikan sebagai bentuk apresiasi kami kepada penulis dan memastikan kualitas karya yang lebih baik dibandingkan dengan jurnal berbayar. Yang tidak kalah penting adalah kami memberanikan diri untuk melawan arus besar internasionalisasi dengan mendesain Jurnal Pro Natura sebagai jurnal berbahasa Indonesia. Pilihan ini tidak berangkat dari sebuah sentimen nasionalisme, namun didasari oleh sebuah tanggung jawab intelektual untuk menumbuh suburkan perdebatan hukum dan tata kepengurusan lingkungan di Indonesia dengan agenda untuk mendorong transformasi sosial yang adil dan lestari.</p>Agung Wardana

<p>Departing from the spirit of strengthening environmental law enforcement against polluters and environmental degraders, the concept of strict liability has continuously developed in Indonesia. This article examines how strict liability has evolved in environmental legislation in Indonesia and how the courts have interpreted it in environmental adjudication. Using a doctrinal legal research method with conceptual, historical and decision study approaches, this article argues that there are inconsistencies and ambiguities in understanding the concept of strict liability as civil liability in Indonesia. To overcome these problems, strict liability should be placed separately from the civil liability standard for tortious acts.</p>Etheldreda E L T Wongkar

<p>The general election for the Indonesian presidency in 2024 resulted in the victory of Prabowo-Gibran. Their official election paves the way for their inauguration as the President and Vice President of Indonesia in October 2024, serving from 2024 to 2029. This paper seeks to undertake a critical review of the vision, mission, and agenda of Prabowo-Gibran concerning the energy transition by comparing with existing regulations, proposed energy policies, and discussions on renewable energy management. Employing a qualitative methodology, specifically policy analysis, this paper reviews the vision, mission, and proposed actions of the newly elected administration, starting a new era of governance. It founds that the future Prabowo-Gibran’s energy policy is: 1) emphasising the role of renewable energy in meeting energy demands rather than emission reduction; 2) weak in its orientation toward an inclusive approach to energy governance; 3) overlooks the role of rural regions in energy governance.</p>Rindu FirdausIstianto Ari Wibowo

<p>Since being implemented by the Joko Widodo administration in 2019, Food Estate, a large-scale government-led agriculture project, has been causing massive environmental destruction over several parts of the Indonesian archipelago. This article analyses Food Estate as a form of environmental crime. Utilizing green criminology as a conceptual framework with ecocide as a legal-conceptual framework, this article aims to explain how the state is the leading actor for the environmental harms by mobilizing a food security narrative as a moral and political justification as well as the legal engineering process for legal justification over the project. Severe, widespread, and longterm environmental destruction as the impacts of Food Estate shows that the state has been the primary perpetrator of ecocide and should be considered liable.</p>Dzaki Darmawardana

<p>This article begins with a brief reflection on a court decision related to a conflict between the Awyu indigenous community in Papua and an oil palm company. Using a critical review of the court decision, this research reveals that the legal mobilization carried out by the Awyu indigenous community is not solely about identity or the environment. The mobilization should be seen as a class struggle to confront extractive capitalism in Awyu’s customary territory. In response to the struggle, the courts have refused to engage with the discourse of Awyu identity attached to their environment and livelihoods. This refusal demonstrates how indigenous identity can be a stumbling block to state-backed extractive projects. This article argues that the courts’ failure to consider identity as part of the construction of the legal relationship between indigenous peoples and their environment may lead to the failure of environmental law to realize intergenerational justice.</p>Syahwal

<p>Environmental conflict is a type of conflict that concerns the lives of many people, and often occurs between citizens and the state. This is because state policy is directed at economic development while ignoring aspects of environmental preservation. In this article, the author formulates a form of environmental conflict resolution by strengthening the position of the subdistrict head as a mediator. This paper uses normative legal research methods with a conceptual and statutory approach. The author found that there is potential for the sub-district head to be used as a mediator in resolving environmental conflicts. However, currently regulatory improvements are still needed so that this role can run optimally.</p>Muhammad Fikri Alan
