The project poses significant challenges regarding the application of the precautionary principle, given the not yet fully understood potential environmental impacts on sensitive deep-sea ecosystems. This article examines the Solwara 1 project to provide important insights for Indonesia in the development of seabed mining by demonstrating how the application of the precautionary principle in the project encompasses a range of mitigation measures and rigorous risk management strategies. However, it also identifies challenges in implementing this principle, particularly related to the limited scientific data on the target ecosystem and the uncertainty surrounding long-term impacts. Additionally, local stakeholder engagement and transparency in decision-making require improvement to ensure the project’s equity and sustainability. For Indonesia, the implications of these findings underscore the importance of the precautionary principle and the development of more sophisticated regulations and technologies to support responsible and sustainable seabed mining.
Agnes Ariningtyas Copyright (c) 2025 The author(s) https://creativecommons.org/licenses/by-sa/4.0 https://journal.ugm.ac.id/v3/Pro-Natura/article/view/13504 Thu, 26 Jun 2025 13:22:32 +0700 Pengendalian Pemanfaatan Ruang Sempadan Sungai: Studi Kasus Kampung Warna-Warni Jodipan, Malang https://journal.ugm.ac.id/v3/Pro-Natura/article/view/13514
This article discusses the efforts of the sub-district to manage Kampung Jodipan, located on the banks of the Brantas River in Malang, through spatial planning. Methodologically, this article employs a doctrinal approach, drawing on primary and secondary sources, and is presented in a descriptive-analytical manner. The article argues that the eviction of the village, which is deemed to violate the riverbank regulations, is not an appropriate solution. In this context, the article demonstrates how the Jodipan Village Administration, instead of evicting the residents, is taking steps to restore the slum into Kampung Warna-Warni (Colourful Village) as a more effective approach to addressing environmental and slum issues along the Brantas River. This is evidenced by the improvement in environmental conditions and the provision of infrastructure supporting environmental management that is far more adequate in the area.
Kevin Daffa Athilla, Arifin Setyo Budi, Jasmine Natasha Pramestiti Copyright (c) 2025 The author(s) https://creativecommons.org/licenses/by-sa/4.0 https://journal.ugm.ac.id/v3/Pro-Natura/article/view/13514 Thu, 26 Jun 2025 13:26:12 +0700 Pengembangan Energi Baru dan Terbarukan di Indonesia Ditinjau dari Pembangunan Berkelanjutan dan Tata Kelola Lingkungan yang Baik https://journal.ugm.ac.id/v3/Pro-Natura/article/view/13518
Currently, the need for clean energy is a global concern. This is due to the massive use of fossil fuels, which release greenhouse gas (GHG) emissions, causing climate change and global warming. In this case, new and renewable energy is the solution to these global environmental problems. Indonesia has committed to reducing GHG emissions through its Nationally Determined Contribution (NDC) as part of its obligations under the Paris Agreement. This article aims to review Indonesia's renewable energy policies, assessing how well they align with the Sustainable Development Goals and adhere to the principles of good environmental governance. This article argues that the development of sustainable energy in Indonesia requires new thinking and systems, so regulations on new and renewable energy must be incorporated into comprehensive regulations that align with sustainable development and good environmental governance.
Muhammad Srinoto Samudra Copyright (c) 2025 The author(s) https://creativecommons.org/licenses/by-sa/4.0 https://journal.ugm.ac.id/v3/Pro-Natura/article/view/13518 Thu, 26 Jun 2025 13:24:07 +0700 Partisipasi Hijau Bermakna (Meaningful Green Participation) sebagai Perwujudan Pemerintahan yang Ekokratis https://journal.ugm.ac.id/v3/Pro-Natura/article/view/17927
The enforcement of environmental law encompasses administrative, criminal, and civil law mechanisms. Administrative law enforcement is closely related to the administration of government itself. One of the key elements of administrative law is the regulation of public participation procedures. In this regard, this article will discuss the ideal construction of public participation in government administration in Indonesia, particularly in areas that impact the environment, and the development of participation in creating an ecocracy within the government administration process through doctrinal legal research. This article proposes a construction of Meaningful Green Participation as a combination of the concepts of public participation, environmental participation, and meaningful participation. Meanwhile, this article argues that creating an ideal ecocracy requires participation that provides space for environmental interests (deep-ecological participation) through the involvement of all aspects of life (all-life control).
Fredrick Binsar Gamaliel Manurung Copyright (c) 2025 The author(s) https://creativecommons.org/licenses/by-sa/4.0 https://journal.ugm.ac.id/v3/Pro-Natura/article/view/17927 Thu, 26 Jun 2025 00:00:00 +0700 The Nexus Between Human Rights and Climate Justice: Climate-Induced Internally Displaced Persons within Indonesia Law https://journal.ugm.ac.id/v3/Pro-Natura/article/view/18009
Climate change threatens human life. One of the ways it does so is by forcing people to migrate, either across national borders or within their own country, becoming internal refugees. This article questions how Indonesia's legal system specifically addresses internal refugees affected by climate change as a vulnerable group. This article addresses two main questions: first, what are the considerations for regulating internally displaced persons due to climate change within Indonesia's legal system? Second, how does Indonesia's current legal framework balance human rights and climate justice perspectives regarding internally displaced persons caused by climate change? This article concludes that internally displaced persons due to climate change are currently regulated through general provisions. As a result of these general regulations, the human rights and climate justice aspects for internally displaced persons due to climate change, which have specific dimensions, are not yet adequately accommodated and protected in the existing regulations.
Muhammad Farkhan Copyright (c) 2025 The author(s) https://creativecommons.org/licenses/by-sa/4.0 https://journal.ugm.ac.id/v3/Pro-Natura/article/view/18009 Thu, 26 Jun 2025 13:17:05 +0700
